Rare Special Award Won in Ontario Personal Injury Case After Insurer Knew It Was Wrong and Did Nothing

Special awards are rare at the Licence Appeal Tribunal. They only happen when an insurer’s conduct crosses the line into excessive, stubborn, or unreasonable. Lisa Bishop, on behalf of our personal injury team, just secured one, and the Tribunal’s reasoning is damning.

Economical Insurance Company denied a client’s prescription expense claims for six years, arguing she needed a treatment plan before it would pay. The law is clear that no plan is required for prescription drugs recommended by a regulated health practitioner. Lisa’s office told the insurer this, in writing, more than once. The insurer never responded with an answer, and never changed its position, for six years.

The Tribunal’s findings:

  • The insurer’s legal position was wrong from the start.
  • Asked directly to cite the section of the Schedule it relied on, the adjuster never did.
  • The insurer had all the medical evidence it needed to reconsider and simply chose not to.

Vice Chair Rebecca Hines awarded a 50 percent special award, the kind of penalty reserved for insurer conduct the Tribunal considers genuinely unreasonable, plus interest and payment of the benefits that should have been approved years ago.

This case also had a longer road behind it. The client’s original hearing in 2023 was dismissed, a decision later quashed by the Divisional Court after Campisi Law argued successfully that her client had been denied a fair chance to challenge the insurer’s own examiner. The matter came back for a full rehearing, and this time the Tribunal saw the case for what it was.

Julia Vilorio Peguero

Julia has dedicated her career exclusively to personal injury law, representing accident victims before the Superior Court of Justice, the Financial Services Commission of
Ontario, and the Licence Appeal Tribunal. Her multilingual capabilities have made her an important point of connection for clients navigating the legal system in their first language. Imtiaz Hosein

Imtiaz began his career at Campisi Law as a first-year lawyer in 2017 and has grown into one of its leading advocates in high-stakes injury, disability, and insurance litigation. He has been at the centre of many of the firm’s most significant cases, achieving multimillion-dollar settlement results and leading court fights advancing important Charter and disability-rights issues. Adam Kuciej

He has represented clients at every level of Ontario’s court system and has completed applications for leave to appeal to the Supreme Court of Canada. His expanding medical malpractice practice brings the same standard of accountability to clients harmed by medical negligence that has defined his personal injury work since he joined the firm. Meghan Fyall Secures $13,019 Special Award After Insurer Unreasonably Delays Benefits for Over Two Years

Special awards are rare at the LAT.  They’re only granted when an insurer’s conduct is found to be excessive, stubborn, or unreasonable. Meghan Fyall just secured one for our client.

After a November 2022 accident, Onlia Insurance Company kept our client confined to the Minor Injury Guideline (MIG) for over two years, denying nearly every treatment plan and attendant care benefits.

What changed? Only after our client filed an application with the LAT and retained legal representation did the insurer finally act:

  • Removed client from MIG on November 26, 2024, two months after the case conference
  • Approved all previously denied treatment plans and $3,000/month in attendant care benefits
  • No new medical evidence was submitted, this reversal happened because lawyers got involved

The Tribunal found:

  • The insurer violated statutory timelines by responding to a treatment plan 11 days late (not the required 10 business days)
  • The insurer knew about this error after retaining counsel but waited months to correct it
  • The delays were unreasonable and forced our client to seek LAT relief, incurring additional costs


The result: A 15% special award totaling $13,019.34, plus interest on all overdue treatment plans.
This case demonstrates why legal representation matters. Insurance companies are not on your side. They denied everything for two years until lawyers stepped in. Meghan’s advocacy held the insurer accountable and secured both the benefits and the award our client deserved.
