How Can Campisi Birth Injury Lawyers Help My Claim?

At Campisi LLP, we give families a voice during their most difficult moments. Our birth injury lawyers handle all legal matters so you can focus on your child’s care and your family’s well-being.

Investigating Your Claim

We conduct a detailed investigation to build the strongest possible case. This includes reviewing medical reports, witness statements, and other key documents, as well as working with respected medical experts to uncover every relevant fact.

Determine Catastrophic Impairment

A catastrophic impairment designation can make a life-changing difference in the amount of compensation your child may receive. In medical malpractice cases, this designation is used to calculate damages, and qualifying can result in significantly higher awards, critical when lifelong care is needed. We work closely with medical professionals to determine whether your child’s injury meets these criteria and ensure it is recognized under the law.

Advising You at Every Step

Our team is in constant contact, updating you at each step of your legal journey. We offer transparent advice and practical support, enabling you to make the best decisions for your family and your child’s future. Calculating Compensation

We partner with economists and other experts to accurately calculate both current and future needs, aiming to provide peace of mind that your child will be financially secure for life. Compensation may include:
  • Medical expenses (past, present, and future)
  • Ongoing care costs, including rehabilitation, assistive devices, and home modifications
  • Pain and suffering
  • Loss of future income

Loss of future income is particularly complex in birth injury cases. Since the victim is an infant, projections are based on factors such as family education and income history, as well as the severity of the injury. In some cases, punitive damages may also be awarded to hold negligent parties accountable for serious misconduct.

Negotiation with Insurers

Dealing with insurance companies after such a traumatic event can be overwhelming. We manage the entire process, paperwork, negotiations, offers, counteroffers, mediation, and will proceed to trial when necessary to protect your child’s rights.

What is a Birth Injury?

Various risks exist during childbirth for both mothers and infants, including the risk of injury. The American Academy of Pediatrics defines birth injuries for infants as “the structural destruction or functional deterioration of the neonate’s body due to a traumatic event at birth”. In simple terms, this means that a newborn’s body is damaged or stops working properly because of an injury during birth. Per Healthcare Excellence Canada, examples of birth injuries include:

A 2022 study entitled “Maternal and neonatal trauma following operative vaginal delivery” found that birth traumas are higher in all provinces than previously reported. The report states that operative vaginal delivery is used in around 10%-15% of all deliveries in Canada. Between April 2013 and March 2019, across Canada (excluding Quebec), 25.3% of women who experienced forceps use during birth received injuries. At the same time, 9.6 babies out of 1,000 live births were injured when forceps were used. For vacuum delivery, 13.2% of mothers sustained injuries, while 9.6 babies in 1,000 live births experienced trauma when this delivery method was used.

What Should I Do If I've Suffered a Birth Injury?

Your child’s immediate medical care comes first, and you may also need support for your own health and emotional well-being. Starting early helps preserve evidence, begin the legal process, and secure the resources your child will need for ongoing care.
