Motor Vehicle Spinal Cord Injury

  • Within 10 Days: Return any requests for information within ten days of receiving them
  • Within 30 Days: Claim SABS Accident Benefits
  • Within Two Years: Appeal any adverse insurance claim decisions

For accidents in the workplace, follow these deadlines:

  • As Soon As Possible: Report your injury to your employer
  • Within Six Months: File a Worker’s Report of Injury with the Workplace Safety and Insurance Board (WSIB) within six months of the accident, sooner if possible
  • Within Six Months: Appeal any WSIB decisions within six months

For general tort claims involving the municipality, you must provide written notice of a claim to the government agency within ten days of the accident.

For all personal injury lawsuits, you must start court proceedings within two years of the accident or within two years of becoming aware of the injury (if this occurred later). That said, minors have a longer limitation period, with the two-year countdown starting on their 18th birthday.

Spinal Cord Injury Prevalence, Costs, and Outlook

A 2023 study, published in Frontiers Neurology, found almost 1,200 hospital admissions for spinal cord injuries across Canada in 2019. Around 10% of patients passed away while in hospital, with 1,076 people eventually discharged. The study also estimated the number of Canadians with spinal cord injuries at 30,239, with an almost even split of those with paraplegia (52%) and those with tetraplegia (48%).

However, an earlier study from 2012 estimated the number of people with spinal cord injuries throughout Canada at 85,556, suggesting that the prevalence may be higher. Based on this higher figure combined with national population statistics, a 2019 study estimated the number of spinal cord injury sufferers at 32,500 in Ontario alone. The same study puts the lifetime economic burden of such injury at between $1.5 million and $3 million per person.

In the previous year, a study published in the Journal of Spinal Cord Medicine put the average net lifetime cost of spinal cord injury at $336,000 per person in Ontario; this figure was based on the perspective of the province’s publicly funded health care system. Researchers found that most costs occurred in the year immediately following the injury. People with spinal cord damage typically have higher hospital costs and require more medical care than members of the general population.
