What is a Burn Injury?

Wounds Canada defines a burn injury as damage to the skin or other tissues caused by contact with heat—such as scalds from liquids, grease, or steam; contact burns; and fire, flash, or flame—as well as extreme cold, electricity, radiation, or chemicals.

Burn severity can range from mild to life-threatening:

  • Superficial burns (first-degree): Typically cause reddened skin.
  • Partial-thickness burns (second-degree): Often involve blistering.
  • Full-thickness burns (third-degree): Usually require surgical treatment.
  • Fourth-degree burns: Damage extends into deep tissues, such as bone, muscle, or tendons.

Severity is influenced not only by the depth of the burn, but also by factors such as:

  • Size of the affected area
  • Location on the body
  • Duration of exposure
  • Temperature of the source
  • Age of the injured person
  • Pre-existing health conditions
  • Additional injuries, such as smoke inhalation or fractures

Local Focus: Burns in Ontario

A 2022 study found that up to 100 in 100,000 adults in Ontario visit the Emergency Department (ED) yearly with scalds or contact burns. While lower, the average figure is still substantial for flame injuries, at 46 people per 100,000.

Ontario is home to the nation’s largest burn facility: the Ross Tilley Burn Centre. Around 300 people are admitted to the centre each year, with some 30% of these coming from the Greater Toronto Area. 

Advanced burn care reduces the risk of death for those with severe burns, with a report finding a significant reduction in mortality at an Ontario burn center for 2010-2013 compared to 2003-2006. That said, specialized burn care is pricey and typically involves lengthy hospital stays. Indeed, a 2024 Canadian study reports an average initial hospitalization cost of $32,360. Furthermore, serious burns typically require ongoing medical care, often for years.

What Should I Do if I've Suffered a Burn Injury?

You should seek prompt medical attention as soon as you’re injured. As soon as possible afterwards, other steps include:

  • Following all guidance from your clinical team and attending all ongoing medical and therapeutic appointments.
  • Recording facts about the incident, including when and where it took place, witness information, and the circumstances of the accident.
  • Reporting the incident to the appropriate parties, such as your employer, the police, or a property owner.

If you received burns in a motor accident, you should also:

  • 7 Days: Tell the Accident Benefits insurance company about your accident and injuries within seven days.
  • 10 Days: Respond to insurance information requests within ten days of receipt.
  • 30 Days: Return the Accident Benefits application within 30 days of receiving it.
  • Two Years: Appeal any SABS decisions with the Licence Appeal Tribunal within two years.

Additionally, if your accident involved the municipality, you should inform the relevant agency, in writing, within ten days.

For other claims under general tort law, you must commence personal injury litigation for burn injuries within two years of the incident. However, exceptions apply for minors, who generally have two years from turning 18 to start a lawsuit.
