What Should I Do If I've Suffered a Brain Injury?

Your health and safety come first. If you’ve been injured, seek medical attention right away. Once you’ve received care, there are important legal steps to take as soon as possible:

  • Document key details about the accident, including where and how it happened, names of witnesses, and anyone else involved. This helps preserve important information for your claim.
  • Notify your Accident Benefits insurer within seven days of the accident.
  • If a government or municipality is involved, provide written notice within ten days.
  • Respond promptly to requests from insurance companies—typically within ten days of receiving them.
  • Return your Accident Benefits application within 30 days to avoid delays or denial of benefits.
  • Start your legal claim within two years of the accident—or from when you became aware of the injury, if later. This deadline may be extended for individuals under 18.

What is a Brain Injury?

Ontario Brain Injury Association explains that there are two types of acquired brain injury (being injuries that occur after birth):

  • Traumatic brain injuries (TBIs)
  • Non-traumatic brain injuries. 

Traumatic brain injuries, defined by the association as “damage to the brain caused by a traumatic event such as a blow to the head, a fall, a motor vehicle or sports-related injury”, are those most relevant to personal injury law. In simple terms, TBIs are caused by something outside of the body, while non-traumatic brain injuries come from within (as explained by Brain Injury Canada).

Unfortunately, TBIs can be difficult to detect and are sometimes referred to as “invisible injuries”. Often, the full impact of the injury goes unnoticed until the victim attempts to return to work or resume daily activities.

According to Brain Injury Canada, around 18,000 people are hospitalized nationwide each year due to a traumatic brain injury. The foundation also predicts that by 2031, TBIs will be among the most prevalent neurological conditions across the country.

The Canadian Hospitals Injury Reporting and Prevention Program recorded over 650,000 head injuries between April 2011 and February 2024, with almost 45% of these classified as TBIs. Moreover, a 2020 report from the Public Health Injury of Canada suggests that Emergency Department visits for TBIs are increasing.

Types of Traumatic Brain Injury

Traumatic brain injuries are classified as being mild, moderate, or severe. The severity classification, as assessed by medical professionals using tools such as the Glasgow Outcome Scale-Extended, impacts various aspects, including medical treatment and legal outcomes.

Concussions are a type of mild TBI, the most common type of traumatic brain injury. However, any brain injury, even one initially described as mild, can result in a broad range of physical, cognitive, and psychological impairments. Other types of TBIs include:

  • Diffuse axonal injury
  • Skull fracture
  • Hematoma
  • Contusion
  • Post-traumatic dementia
  • Chronic traumatic encephalopathy

Brain trauma may also lead to diverse secondary damages.
